These Terms of Service ("Terms") govern your use of NotientAI (notientai.com), an AI-powered social-proof and conversion platform (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Account
You must provide accurate registration information and are responsible for keeping your password secure. You must be at least 18 years old (or the age of majority in your country) to use the Service. One person or legal entity may not maintain more than one free trial account.
2. Plans & billing
- NotientAI offers Starter ($9/mo), Growth ($29/mo), Pro ($99/mo) and a custom Agency plan. All customers are billed in USD via Dodo Payments, our global payment provider.
- Every paid plan begins with a 7-day free trial. Your card is not charged until day 8.
- Subscriptions renew monthly until cancelled.
- Each plan has a monthly notification quota and site limit, listed on the pricing page. You can upgrade or downgrade your plan at any time from Dashboard → Billing.
3. Acceptable use
You agree not to use NotientAI to:
- Deliberately mislead end-visitors by presenting demonstration notifications as verified real customer activity without appropriate disclosure.
- Send unsolicited marketing messages (SPAM).
- Host illegal content, infringing material, or content that violates third-party rights.
- Attempt to reverse-engineer, scrape, or overwhelm the Service or its APIs.
- Resell NotientAI access without a written Agency agreement.
NotientAI operates in two modes:
- Real Data Mode — displays genuine customer activity from your connected data sources. Popups are labeled with a Verified badge.
- Demo Mode — displays AI-generated sample notifications for onboarding and testing purposes. Website owners are responsible for ensuring their use of NotientAI complies with all applicable consumer protection and advertising standards laws in their jurisdiction.
4. Content ownership
You retain all rights to the content you upload (widget copy, brand assets, customer data). You grant NotientAI a limited license to process and display that content for the sole purpose of operating the Service. NotientAI retains all rights to the platform, embed.js script, and underlying technology.
5. AI-generated content
NotientAI uses Anthropic Claude to generate widget copy and weekly performance insights. Generated text is provided "as is"; you are responsible for reviewing it before it goes live. We do not warrant that AI output is free of factual errors.
6. Service availability
We target 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages, or DDoS events may cause temporary disruption.
7. Termination
You can cancel any time from Dashboard → Billing. We may suspend or terminate your account immediately for material breach of these Terms, abuse, or non-payment. Upon termination, your data is retained for 30 days for re-activation, then permanently deleted.
8. Limitation of liability
To the maximum extent permitted by law, NotientAI's aggregate liability for any claim arising from these Terms is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or loss-of-profit damages.
9. Indemnification
You agree to indemnify NotientAI against any claim brought against us by a third party arising out of your misuse of the Service or breach of these Terms.
10. Governing law
These Terms are governed by the laws of India. Any dispute will be resolved in the courts of Bengaluru, Karnataka, India. EU customers retain mandatory consumer rights under their local law.
11. Changes to the Terms
We may update these Terms occasionally. Material changes will be announced by email at least 14 days before they take effect.
